Terms of Use
These Terms of Use (“Terms”) govern your use of “Lean Clinic by ambii” (the “Service”) provided by Ambii Co., Ltd. (“we”, “us”, “our”).
Article 1 (Definitions)
- “User” means an individual who uses the Service.
- “Partner medical institution” means a medical institution that provides online medical services through the Service.
- “Medical services” means medical acts under applicable laws, such as consultation, diagnosis, prescription, testing, and medication guidance.
Article 2 (Acceptance)
By using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Service.
Article 3 (Our role)
We provide scheduling, guidance, systems, payment intermediation, and related support. We are not a medical institution under Japanese medical law and are not the provider of medical services. Medical services are provided by physicians at partner institutions under their professional responsibility.
Article 4 (Registration)
You must provide accurate, current information through our designated procedures. We may refuse or suspend use if information is false, if you impersonate another person, or if we otherwise deem use inappropriate.
Article 5 (Service contents)
The Service may include, without limitation:
- Booking online visits and submitting intake information
- Systems to facilitate video visits
- Payment intermediation for medical fees and related charges
- Administrative support for shipment status, as applicable
Features may be added or modified with notice as appropriate.
Article 6 (Medical contracts)
Contracts for medical services are formed between you and the partner medical institution. We are not a party to those contracts and are not liable for medical outcomes. Prescribing decisions rest solely with the physician.
Article 7 (Fees and payment)
Fees and breakdowns follow displays on the Service and explanations during visits. Payment methods are limited to those we or our partners designate.
Article 8 (Shipping)
Shipping of pharmaceuticals, if any, is the responsibility of the partner institution or its delegates. We are not liable for delays due to force majeure beyond the extent required by applicable law.
Article 9 (Returns and cancellations)
Due to product characteristics, returns, exchanges, or cancellations for customer convenience may not be accepted after prescription is confirmed or after shipment. Contact us or the partner institution within the stated period if there is a wrong item or defect.
Article 10 (Prohibited conduct)
You must not:
- Register false information or make false statements to physicians
- Transfer or resell prescribed drugs, or use them contrary to medical instructions
- Engage in unauthorized access, interfere with operation, or infringe third-party rights
- Violate laws or public order and morality
- Engage in any other conduct we deem inappropriate
Article 11 (Suspension and termination)
We may suspend or terminate your access without prior notice if you breach these Terms.
Article 12 (Intellectual property)
Rights in trademarks, content, software, and other materials belong to us or our licensors. Unauthorized copying is prohibited.
Article 13 (Disclaimer; limitation of liability)
Except for our willful misconduct or gross negligence, our aggregate liability for damages to a User is capped at the total fees paid to us by that User in the six months preceding the event. Mandatory consumer laws remain unaffected where applicable.
Article 14 (Changes and discontinuation)
We may change or discontinue the Service with reasonable notice to Users.
Article 15 (Changes to the Terms)
We may revise these Terms. Revised Terms take effect when posted on this website unless stated otherwise; continued use constitutes acceptance.
Article 16 (Privacy)
Personal data is handled in accordance with our Privacy Policy.
Article 17 (Governing law and jurisdiction)
These Terms are governed by the laws of Japan. The Mito District Court shall have exclusive first-instance jurisdiction.
